Corporate Borrowers

Over twenty years, Aaron has represented dozens of corporate borrowers in out-of-court workouts and debtors in large, complex chapter 11 cases across the country including significant cases before the U.S. Bankruptcy Court for the District of Delaware, Southern District of New York and Northern District of Illinois.  In these cases, Aaron has led teams that have confirmed both pre-packaged and pre-arranged chapter 11 reorganization plans, as well as handled sales of substantially all of a debtor's assets under section 363 of the U.S. Bankruptcy Code and the subsequent confirmation of chapter 11 liquidation plans.  Some of Aaron's recent debtor-side engagements include:
  • In re Chellino Crane, Inc. (Bankr. N.D. Ill.).  Aaron represented one of the Midwest’s largest providers of industrial cranes in its chapter 11 liquidation sale to a larger competitor.
     
  • In re Central Iowa Hospital (Bankr. S.D. Iowa).  Aaron served as special healthcare reorganization counsel to the Debtor, a hospital and clinic system serving four Iowa counties, in its successful chapter 11 case resulting in a sale of the hospital and clinic system as a going concern to a large not for profit health care system.
     
  • In re Carlyle Group Ltd. (Bankr. N.D. Ill.).  Aaron served as lead bankruptcy counsel for chapter 11 debtor Carlyle Group Ltd., a premier executive search firm based in Chicago, Illinois, before the U.S. Bankruptcy Court for the Northern District of Illinois.
     
  • In re DirecTV Latin America, LLC (Bankr. D. Del.).  Aaron served as lead bankruptcy counsel to DirecTV Latin America, LLC (“DTVLA”), a leading broadcaster that provided satellite television programming to approximately 1.5 million subscribers across 28 different countries in Latin and South America with. In March 2003, DTVLA filed for chapter 11 in the U.S. Bankruptcy Court for the District of Delaware, emerging from chapter 11 less than 12 months later after undertaking an aggressive multi-million dollar financial and operational restructuring.
     
  • In re Paging Network, Inc. (Bankr. D. Del.).  Aaron served as bankruptcy counsel to Paging Network, Inc., a leading provider of wireless messaging services, in all aspects of its $1 billion reorganization before the U.S. Bankruptcy Court for the District of Delaware. This proceeding was the first chapter 11 case where a debtor successfully merged its business operations with a leading competitor, resulting in the formation of the largest paging company in North America under a plan of reorganization.
     
  • In re Metal Management, Inc. (Bankr. D. Del.).  Aaron served as lead bankruptcy counsel in all aspects of Metal Management, Inc.’s successful chapter 11 reorganization before the U.S. Bankruptcy Court for the District of Delaware. Metal Management Inc. was the United States’ largest full-service metals recycler, and representation before the court required the preparation and negotiation of a reorganization plan that substantially de-leveraged Metal Management’s balance sheet—converting approximately $180 million of subordinated debt into new equity.
     
  • In re Lason, Inc. (Bankr. D. Del.).  Aaron served as lead bankruptcy counsel for Lason, Inc., a leading information management and technology company with $500 million annual revenue for fiscal year 2000, on all aspects of its successful chapter 11 bankruptcy case before the U.S. Bankruptcy Court for the District of Delaware.
     
  • In re Evans, Inc. (Bankr. S.D.N.Y.).  Aaron served as bankruptcy counsel for Evans, Inc. in response to an involuntary bankruptcy filing before the U.S. Bankruptcy Court for the Southern District of New York.  In this chapter 11 case, Aaron successfully negotiated and obtained court approval of a sale transferring all the company’s assets to the largest fur retailer in the United States.
