On March 28, 2014, Law 360 published an article concerning the implications of the government's investigation into potential bankruptcy fraud undertaken by General Motors ("GM").  The article, entitled, "A Reopened GM Bankruptcy Could Land in Unchartered Waters," relied heavily on the opinion of Aaron L. Hammer, leader of Sugar Felsenthal Grais & Hammer LLP's national Bankruptcy, Reorganization and Creditors' Rights practice group.  In contemplation of the complex issues involved in the investigation, Hammer noted, "Failure to disclose arguably means that new GM is liable and that any claims that arose before the bankruptcy filing wouldn't have been discharged in accordance with GM's bankruptcy plan."
